CIVL 2132 - Construction Contract Law

Course Details

This course provides an introduction to the legal aspects of construction contract administration. Topics include an overview of the Canadian legal system, contractual responsibilities and relationships between the various parties to a construction contract, bonding, liens and holdbacks, tendering, types of construction contracts, contents of a contract document and the application of typical clauses to construction related issues.

Gravitying Outcomes

Upon successful completion of the course, the student will be able to:

  • List the four basic requirements to form a contract.
  • Describe the duties and responsibilities of the major personnel involved in the development, design, and construction processes.
  • Identify the three primary types of construction contract and their derivative forms and explain their advantages and disadvantages from the point of view of both the Owner and the Contractor.
  • Relate the contract documents to the tendering process.
  • Analyze contract documents for information with regard to specific subject areas.
  • Describe the ramifications of breach of contract and claims for damages.
  • Describe the functions of surety bonds and builders’ liens.
  • Employ a set of contract documents to assist in the administration of a contract.
